Introduction

Welcome to Make Theory! These Terms of Service govern your use of our website at maketheory.ca and all services provided by Make Theory, including live experiential activations, custom merchandise, laser engraving, embroidery, photo booth experiences, and related offerings. By accessing our website or booking our services, you agree to comply with these terms and conditions. If you do not agree, please do not use our platform or services.

User Responsibilities

Inquiry & Booking: When submitting an inquiry or booking a service through our platform, you agree to provide accurate and complete information. You are responsible for ensuring all event details provided to Make Theory are correct.

Prohibited Activities: You agree not to engage in any illegal, unauthorized, or abusive activities in connection with our website or services. This includes but is not limited to submitting false inquiries, infringing on intellectual property rights, or misrepresenting your identity or event details.

Content Submissions: Any artwork, logos, or files you submit to Make Theory for use in custom orders or activations must not infringe upon the intellectual property rights of third parties. By submitting artwork or files, you confirm you have the right to use and reproduce that content.

Intellectual Property

All content on the Make Theory website — including but not limited to text, graphics, logos, photography, and design — is the property of Make Theory and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without our express written permission.

Custom work produced by Make Theory for your event or order remains the property of Make Theory until full payment is received. Make Theory reserves the right to photograph completed work and activations for portfolio and marketing purposes unless otherwise agreed in writing.

Privacy

Your privacy matters to us. Make Theory collects personal information — including name, email, phone number, and event details — solely for the purpose of responding to inquiries and fulfilling services. Bookings, Payment & Deposits

Deposits: A 50% deposit is required to confirm your booking. Your event date is not secured until the deposit is received.

Final Payment: The remaining balance is due 7 days prior to your event date.

Custom Orders: Custom merchandise orders require a deposit at the time of artwork approval. Full payment is due before production begins or items are shipped.

Payment Processing: Payments are processed securely. Make Theory does not store credit card information.

Taxes: All prices are subject to applicable GST and PST as required under British Columbia and Canadian federal tax law.

Cancellation & Refund Policy

Cancellations made 60+ days before the event: Full deposit refund.

Cancellations made within 60 days of the event: Deposit is non-refundable.

Rescheduling: We are happy to reschedule your event with a minimum of 30 days notice, subject to availability.

Custom Orders: Once artwork has been approved and production has begun, orders cannot be cancelled or refunded unless there is a production error on our part.

Make Theory Cancellations: In the unlikely event Make Theory must cancel due to circumstances beyond our control, a full refund of all payments received will be issued.

Disclaimer of Warranties

Make Theory's website and services are provided on an "as is" basis. While we take every measure to deliver high quality results, we do not guarantee specific outcomes for custom work as results may vary based on materials, garment types, and artwork complexity. We are not liable for variations in color, texture, or finish that fall within normal production tolerances.

Limitation of Liability

To the fullest extent permitted by applicable law, Make Theory shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim arising from a service shall not exceed the amount paid by you for that specific service.

Indemnification

You agree to indemnify and hold harmless Make Theory, its owners, affiliates, and employees from any claims, damages, or liabilities arising from your use of our services, submission of infringing artwork or content, or violation of these terms.

Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be resolved through good faith negotiation, and if unresolved, through arbitration in British Columbia, Canada.

Changes to Terms

Make Theory reserves the right to update or modify these terms at any time. Revised terms will be posted on our website with an updated date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
